Individual Results May Vary

We do not guarantee specific outcomes (e.g., "brain‑fog‑free 10‑hour workdays"). Results depend on many factors, including your adherence to the program, your unique physiology, genetics, lifestyle, and other factors beyond our control.

Scope of Services

Our coaching is limited to the protocols and guidance provided in the 5‑Phase Gut CEO Protocol. We do not treat, cure, or prevent any disease. We are not medical doctors, dietitians, or licensed healthcare professionals.

6. Online Payments and Refund Policy

Payment Processing

Payments for our Services are processed through third‑party providers (e.g., Stripe, PayFunnels). For international clients, payments will be accepted in USD and may be subject to currency conversion fees. You agree to pay all fees associated with your purchase.

Refunds

Unless a specific product or service description states otherwise, no refunds are offered for digital products, online courses, or coaching packages once access has been granted. If you have questions, please contact us before purchasing.

For coaching programs that include a "money‑back guarantee," the terms of that guarantee will be clearly stated in the Coaching Services Agreement. To be eligible for a refund under that guarantee, you must complete the full program and follow all protocols as outlined.

7. International Clients

Legal Compliance

The Client is responsible for understanding and complying with any local laws and regulations regarding the services provided.

Time Zones

All coaching sessions will be scheduled in the Eastern Time Zone (ET) . The Client must consider time zone differences when attending sessions.

 

Currency

All payments will be processed in USD and may be subject to currency conversion fees.

We will respond to inquiries within 24‑48 hours on business days (Monday to Friday, excluding statutory holidays).

8. Disclaimers and Limitation of Liability

A. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 9. No Guarantee of Results

The Coach does not guarantee any specific results beyond the satisfaction guarantee outlined in the Coaching Services Agreement. Individual results vary depending on adherence, genetics, lifestyle, and other factors beyond our control.

 

10. Indemnification

You agree to indemnify, defend, and hold harmless Health Ascendance and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

 

Your use of the Site or Services.

 

Your violation of these Terms.

 

Your violation of any third‑party rights.

Any content you post or submit.

 

11. Termination

We may, in our sole discretion, suspend or terminate your access to the Site or any Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, you must cease all use of the Site and destroy any downloaded materials.

13. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

 

Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration in accordance with the rules of the Canadian Arbitration Association in Toronto, Ontario. The arbitration shall be conducted in English, and the arbitral award shall be final and binding upon the Parties.

 

For the purpose of enforcing any arbitral award, the Parties hereby irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of the Province of Ontario, and waive any objection to venue or forum non conveniens in such courts.

 

You agree to waive any right to participate in a class action.

 

14. Refund Policy (General)

As stated in Section 6, refunds are generally not provided for digital products or coaching services once delivered. If a "money‑back guarantee" is offered for a specific program, the terms will be clearly disclosed in the Coaching Services Agreement. Any refund request must be made in writing to the contact address below.

 

15. Miscellaneous

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

 

No Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

 

Entire Agreement

These Terms constitute the entire agreement between you and Health Ascendance regarding your use of the Site and Services.
